Each man gave a statement to police out of the presence of the other. The statements were admitted into evidence, with a limiting instruction, over Rodriquez's objection. From his conviction, Rodriquez appeals. We reverse and remand for a new trial. On September 19, 1978, at approximately 3:30 p.m., the body of a young woman was discovered laying face down in the Kaw River in Wyandotte County. Police officer Randy Murphy was called to the scene.
